1 WASDstore: located in Enkhuizen and registered with the Chamber of Commerce under registration 63719355 trading as WASDstore.
2 Website: consult the website of WASDstore through www.wasdstore.nl and all its subdomains.
3 Customer: the natural person not acting in a professional or company who enters into an agreement with WASDstore and / or has registered on the Website.
4 Agreement: any agreement or contract between WASDstore and Customer of any agreement to the Terms integral part.
5 Conditions: these Terms and Conditions.
1 On all offers, agreements and deliveries of WASDstore the General Conditions apply, unless expressly agreed otherwise in writing.
2 If Customer in his order, acknowledgment or acceptance uses conditions that deviate from or are not included in the General Conditions, they are only binding for WASDstore insofar as they are accepted by WASDstore in writing.
3 In the event that specific product or service conditions apply in addition to these Terms and Conditions, those terms also apply, but to the customer in case of conflicting terms always rely on the applicable provision that is most favorable to him.
4 By using the Site or Services you signify your agreement to be bound by these Regulations. You are requested not to use the Site or any Service if you do not accept the Regulations in the General Conditions.
5 WASDstore.nl reserves its right to make any changes and modifications to these General terms, including the right to introduce new provisions and delete the previous ones, which can be done unilaterally and at its own discretion and at any time through publication of the amended Terms and Conditions on the Site. Therefore it is the User’s obligation to check on a regular basis whether the Terms and Conditions were subject to amendments.
6 In the event that the General Terms are translated into any other language and there is any inconsistency between the English version and such translation, the Dutch version shall prevail.
Prices and information
1 All prices mentioned on the website and in other materials WASDstore include VAT and other levies imposed by the government.
2 The prices include shipping.
3 The content of the website has been compiled with the utmost care. WASDstore can not guarantee that all information on the website at any time is accurate and complete. All prices and other information on the Web site and in other WASDstore derived materials are also subject to manifest programming and typing errors.
4 WASDstore can not be held responsible for (color) changes as a result of display quality.
1 The Agreement is concluded at the time of acceptance by the customer and the fulfilment of the conditions set by WASDstore.
2 If customer accepts the offer electronically, WASDstore immediately acknowledges the electronic receipt of acceptance of the offer. Until receipt of this acceptance has not been confirmed, the Customer may terminate the Agreement.
3 If it appears that the provided personal data in the acceptance/agreement by the Customer is inaccurate WASDstore is entitled only to meet its obligations after the correct data is received.
4 WASDstore may notify within the law if the Customer can meet its payment obligations and all facts and factors relevant to establish a responsible agreement. If WASDstore has grounded reasons, WASDstore is entitled to refuse an order or request special conditions such as prepayment.
5 WASDstore is entitled to refuse orders from customers who order to run their profession or business.
1 To make the best use of the Website, a Customer can register via the registration / account logon option on the Website.
2 During the registration process, Customer chooses a username and password with which he can log in after registering on the website. Customer is responsible for selecting a sufficiently reliable password.
3 Customer must keep his login username and password strictly confidential. WASDstore is not liable for abuse of login data and should always assume that a customer who registers on the website actually is the Customer. All that is done via the Customer’s account, is the responsibility and risk of the Customer.
4 If the Customer knows or suspects that his credentials have come into unauthorized hands, he should as soon as possible change his password and / or notify WASDstore so WASDstore can take appropriate action.
1 Once the order is received by WASDstore, WASDstore send the products in compliance with paragraph 3 of this Article applies as soon as possible.
2 WASDstore is entitled to engage third parties to perform the obligations under the Agreement.
3 The delivery time is in principle two days. The delivery can be done in different ways and by choice of WASDstore.
4 If WASDstore can not deliver within the agreed period, WASDstore shall inform the Customer as soon as possible.
Customer may then agree on a new delivery date or terminate the Agreement without charge.
5 WASDstore recommends customers to inspect the products supplied and to report defects found within a reasonable time, preferably in writing or by e-mail,. See more information in the guarantees and conformity section in this article.
6 Once the products have been delivered to the specified delivery address, the risk concerning the products are transferred to Customer. If explicitly agreed otherwise, the risk is already transferred to Customer. If customer decides to collect the goods, the risk passes when the goods transfer.
7 WASDstore is entitled to deliver a similar product of similar quality to the product ordered, if the ordered item is no longer available. Customer is entitled to terminate the contract without charge and return the product free of charge.
Right of withdrawal
1 customer has the right to terminate the Agreement concluded with WASDstore within 14 calendar days of receipt of the product, without giving reasons, free of charge. The period starts on the day after the customer, or a pre-designated by him third party other than the carrier has received the product, or:
as customer in the same order ordered several products: the day on which Customer or a third party designated by, has received the final product.
if the supply of a product consisting of multiple lots or pieces, the day on which Customer or a third party designated by the final shipment of the final part has received;
in contracts for regular delivery of goods during a certain period: the date of Customer or a third party designated by him, received the first product.
2 Only the direct cost of the return shipment will be borne by Customer. Customer therefore need to take the return costs. If these costs exceed the normal postage, WASDstore gives an estimate of these costs.
Any customer paid fee and shipping cost of the product to Customer will be refunded upon return of the entire order to the Customer.
3 Within the withdrawal period the Customer shall carefully handle the product and it’s packaging referred to in paragraph 1 with the product and packaging. Customer will only open the packaging and the product to the extent necessary to determine the nature, characteristics and performance of products. The assumption is that these inspections should not go beyond what customer would do in a physical store.
4 Customer is liable for loss of the product that is the result of a way of dealing with the product beyond the permitted in the preceding paragraph.
5 Customer can send the Agreement terminate in accordance with paragraph 1 of the term by the model withdrawal form set out in this Section (digital) to WASDstore, or otherwise unequivocally indicate to WASDstore that he renounces the purchase. WASDstore confirms case of a digital report the receipt of such notification. After dissolution the customer has 14 days to send the product to WASDstore. It is also possible to send the product back immediately within the cooling off period referred to in paragraph 1 of this Article, provided that included the model withdrawal form or any other unequivocal statement on withdrawal.

6 The customer will receive a full refund including the shipping cost from WASDstore to the customer within 14 days the same way as the customer has payed the order. WASDstore will refund within 14 days after the returned order has been received by WASDstore.
If customer has opted for a more expensive method of delivery than the cheapest standard delivery WASDstore offers we do not refund the additional costs for the more expensive method.
Unless WASDstore offers to pick up the product at the customers adress WASDstore is entitled to wait with the refund untill WASDstore has received the product or the customer can prove WASDstore has received the product that the customer has send back.
7 The Website clearly and in time states on whether or not the right of withdrawal applies.
8 , the right of withdrawal does not apply to:
-Audio- and video recordings and computer software when the Customer has broken the seal;
-Products which are not suitable for reasons of protection of health or hygiene to be sent back and of which the seal has been broken after delivery;
-The supply of digital content other than on a tangible medium if the performance has begun with the explicit prior consent of the customer and he has stated that he thus loses his right of withdrawal.
-The delivery of product codes that are sent by e-mail or sent physically if they are not sealed.
1 Customer must meet payments to WASDstore according to the ordering process and possibly on the website specified payment methods. WASDstore is free to choose to offer payment methods and may also from time to time. In case of payment after delivery Customer has a payment term of 14 days starting on the day after delivery.
2. If the customer is unable to meet its payment (s), it is this, after being rejected by the WASDstore on late payment and WASDstore Customer has granted a period of 14 days in which to comply with its payment obligations, after lack of payment due within the 14-day deadline, the statutory interest on the amount due and WASDstore is entitled to charge the extrajudicial collection costs incurred by that charge. Warranty and conformity

3 If the delivered product does not comply with the Agreement, Customer must notify WASDstore within a reasonable period after the customer discovered the lack thereof.
4 If WASDstore agrees the complaint is grounded, the products will be repaired, replaced or refunded after consultation with Customer. The maximum compensation is equal to the price paid by the customer for the product.
If a customer has a complaint about a product (in accordance with Article concerning warranty and compliance) and / or other aspects of the service from WASDstore, he can send WASDstore a complaint by e-mail or post. See contact information at the bottom of the General Conditions.
2 WASDstore replies the customer as soon as possible, but in any case, within 2 days after receipt of the request, a response to the complaint. If it is not possible to give a substantive or final response, WASDstore will notify the customer within 2 days after the receipt of confirming the complaint and give an indication of the period within which it expects to give a substantive or final response to the complaint of the Customer.
1 WASDstore process the personal data of Customer in accordance with the published Privacy Statement on the website.
1 The Agreement is governed by Dutch law.
2 Unless otherwise prescribed by mandatory law, any disputes that may arise in connection with the Agreement will be submitted to the competent Dutch court in the district where WASDstore is located.
3 If any provision of these Terms is found to be invalid, this will not affect the validity of the Terms and Conditions. The parties will, in that case, replace (a) new provision (s) to establish, which as far as is possible to the intent of the original provision is shaped.
4 “in writing” is also understood to communication by e-mail and fax in this agreement, provided that the identity of the sender and the integrity of the mail is established enough.
